Labour Market Testing (LMT) and UK Free Trade Agreement

Labour Market Testing (LMT) is required for most employer sponsored visa applications to check if there are qualified Australian citizens or permanent residents available to fill the temporary position. However, LMT does not apply if it would be inconsistent with Australia’s international trade obligations.

Under the agreed Free Trade Agreement with the UK, the Department of Home Affairs has confirmed that UK citizens and permanent resident are exempted from LMT when applying for a subclass 482 visa (TSS).

The LMT requirement has long been a prerequisite in employer-sponsored visas and the easing of this requirement for UK passport holders is a welcome relief to Australian employers.

The full agreement can be found here.
